FMLA Expansion Effective Immediately
The DOL confirmed today that the expansion of the Family and Medical Leave Act contained in the 2008 Defense Authorization Act (H.R. 4986) became effective January 28, 2008, the date it was signed into law by President Bush. The DOL also confirmed that draft regulations implementing the expanded provisions are pending review and approval by the White House.
The expansion permits eligible employees to take job protected family medical leave due to exigencies related to active military service and to care for a family member who was injured while serving in the military.

"The President signed into law H.R. 4986, the National Defense Authorization Act for FY 2008 (NDAA). Among other things, section 585 of the NDAA amends the Family and Medical Leave Act of 1993 (FMLA) to permit a 'spouse, son, daughter, parent, or next of kin to take up to 26 workweeks of leave to care for a 'member of the Armed Forces, including a member of the National Guard or Reserves, who is undergoing medical treatment, recuperation, or therapy, is otherwise in outpatient status, or is otherwise on the temporary disability retired list, for a serious injury or illness.' Where is this coming from? I cannot find confirmation anywhere else on the web of the immediate effective date.
